TRENTON – A veteran city police officer and his father have been indicted on charges of fourth-degree false swearing and workers’ compensation fraud, the Mercer County Prosecutor’s Office said.

Gaetano Ponticiello, 42, and his 65-year-old father Filippo made false statements under oath before Judge Renee C. Ricciardelli on February 23, 2009, the prosecutor’s office said.

The indictment alleges the men knowingly misclassified employees of the elder Ponticello’s firm to avoid paying workers’ compensation benefits or premiums to them, the prosecutor’s office said. Both crimes carry a maximum penalty of 18 months in prison and a $10,000 fine, the prosecutor’s office said.

The men are scheduled to appear in Mercer County Superior Court on Oct. 25.
